Terms and Conditions
Abstract
All deliveries and services are made under this general terms and conditions. Contracts may be closed verbally or in written form. Other conditions of purchasing are only valid, if they are agreed in writing. Alterations to the terms and conditions are ineffective, unless confirmed by myself in written form. The customer accepts this terms and conditions as binding for him with each order and all placings of orders respectively.
Proposals
All proposals are subjects to change concerning price, quantity, delivery times and facility of supply. Measures, images, drawings, tables of content etc. are not guaranted. I reserve the right to changes prices as well as stock sales and errors in price-quotation.
Conclusion of a Contract
The conclusion of a contract is accomplished through my confirmation of the order or with the shipping of the products.
Prices
All prices are quoted including the value added taxes (VAT) in effect at the time of delivery. Shipping costs are added as stated in the price list. If it is not possible to deliver all items in one shipment no extra shipping costs will be charged for the subsequent delivery.
Delivery
The delivery takes place from stock to the shipping address specified by the purchaser. The purchaser commits himself to check the goods immediately and to give notice about any material defects. Defective goods have to be stored for an inspection in an unaltered condition.
Terms of Payment
Payment for deliveries in Germany, Austria and Switzerland are due 14 days after receipt of the invoice. Deliveries outside of Germany, Austria and Switzerland are to be paid in advance by credit card or Paypal. The goods remain my property until the full payment has been received. If payment is delayed, a charge of 5 Euro is added for each reminder, with the exception of the first reminder.
Return of products
The customer shall be entitled to return delivered items within 14 days without specifying a reason. Return consignments to me have to be made postage paid. Shipments with unpaid freight-charges or C.O.D. will not be accepted. Received payments will be refunded.
Warranty and Liability
The warranty-period is, unless otherwise agreed, 3 months and starts with the date of delivery. The warranty does not include the normal wear and attrition and expires in case of any alteration of the goods through the customer.
If warrented goods are defective or become defective during the warranty period caused by failures in manufacturing or a material defect, I will – under the exclusion of any other warranties of the customer – repair or replace the defective goods. Multiple repairs are permitted.
Applicable Law
This terms and conditions as well as all other privities of contract between the customer and me shall be governed by and construed in accordance with German law. Any other law as well as the Uniform Law on the International Sale of Goods (according to the Hague Convention) are excluded.
Protection of Privacy
The customer accepts the storage, processing and utilization of personal data exclusively for transactional purposes related to the order itself.
Miscellaneous
If several provisions of this terms and conditions are invalid or will get invalid the legal effect of the other provisions are not affected thereby.
